This Terms and Conditions Agreement (“Agreement”) constitutes a legally binding agreement made between you, whether personally or on behalf of an entity (“The User” or “you” or “your”) and NeoSky India Limited (“NeoSky” or “Company” or “we” or “us” or “our”). The User shall read these terms and conditions (“terms and conditions”, “terms”) carefully before using NeoSky ‘s application (“Product”) owned by RattanIndia Enterprise Limited. (“RattanIndia”).

By using NeoSky (Product), you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to stop using NeoSky App (Product). NeoSky only grants use its products, and services to those who have accepted its terms.

For better use of the products and services available on the NeoSky App (Product), the user is required, to provide certain additional personal information such as first name, last name, phone number, email id, and Aadhaar number. NeoSky will automatically receive and collect certain anonymous information in standard usage logs through their web server, including but not limited to, cookies sent to NeoSky App (Product), mobile network information, standard web log information, traffic to and from NeoSky App (Product), tracking inside the NeoSky App (Product) and any other available information.
The User is required to provide NeoSky with access to certain personal information of the User stored by third party sites. NeoSky will have access to such information to the extent allowed by the user’s privacy settings on that website and the user’s specific authorization. In the event user link its account managed by NeoSky with an account maintained by any third party to enable NeoSky to access certain information maintained in such third party managed accounts, user agree that NeoSky may collect, store and use such information in accordance with this online privacy policy.
Our services may include links to other websites or applications when you visit NeoSky App (Product). Such websites or applications are governed by their respective privacy policies, which are beyond our control. Once you leave our servers (you can tell where you are by checking the URL in the location bar on your browser or on the m-site you are redirected to), use of any personal information that you provide on these websites or applications is governed by the privacy policy of the operator of the application/website, you are visiting. That policy may differ from ours and you are requested to review those policies or seek access to the policies from the domain owner before proceeding to use those applications or websites. We do not accept any responsibility or liability for usage of your Personal Information by these third parties or their policies.
We may access extra information, such as the User’s location, phone and / or any device storage or location and drone location.

When you provide your contact details, we will use it to send you general notices or important news about your account, request your feedback or opinions and provide updates on special deals and offers that might interest you.

Storage of Personal Data

To the extent applicable, we store personal information within India and retain it in accordance with applicable laws and for a period no longer than it is required for the purpose for which it was collected. Age Restriction

You must be at least 16 (sixteen)years of age before you can NeoSky App (Product). By using NeoSky app (Product), you warrant that you are at least 16 (sixteen) years of age, and you may legally adhere to this agreement. NeoSky assumes no responsibility for liabilities related to age misrepresentation.

Intellectual property

You agree that all materials, products, and services provided on NeoSky App (Product) are the sole property of NeoSky, its affiliates, directors, officers, employees, agents, suppliers, or
licensors including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce or redistribute the NeoSky’s intellectual property in any way, including electronic, digital, or new trademark registrations.
NeoSky may use the content to improve the quality of experience.

User accounts

As a user of NeoSky App (Product), you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password.
If you think there are any possible issues regarding the security of your account on NeoSky App (Product), inform us immediately so we may address them accordingly.

Indemnification

You agree to indemnify NeoSky and its affiliates and hold NeoSky harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.

Limitation on liability

NeoSky is not liable for any damages to anyone or anything that may occur to you as a result of your misuse of it.
NeoSky reserves the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between NeoSky and the user, and this supersedes and replaces all prior agreements regarding the use of NeoSky App (Product).

Applicable law

By using NeoSky App (Product), you agree that the laws of India, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between NeoSky and you, or its business partners and associates.

Disputes

Any dispute related in any way to your use of NeoSky App (Product) or its products shall be settled in courts of New Delhi and you consent to exclusive jurisdiction and venue of such courts.
